Die Cannurexa Ltd. ist ein im Vereinigten Königreich registriertes Unternehmen (Companies House, England & Wales, Company No. 16493674) und agiert ausschließlich als Anbieter einer elektronischen Plattform für die Darstellung von medizinischen Cannabisprodukten sowie die Weiterleitung von Bestellungen an zugelassene deutsche Apotheken, gemäß dem Companies Act 2006 (Part 41) und den Electronic Commerce (EC Directive) Regulations 2002 (Reg. 6).

 

Verträge und Steuern

  • Der Kaufvertrag wird ausschließlich zwischen dem Patienten/Kunden und der lizenzierten deutschen Apotheke geschlossen, gemäß § 312 BGB ff.
  • Rechnungen und Zahlungen werden direkt von der deutschen Apotheke abgewickelt, die die volle steuerliche Verantwortung gemäß § 14 UStG (Rechnungsstellung) und § 1 Abs. 1 Nr. 1 UStG (Umsatzsteuerpflicht) trägt.
  • Die Cannurexa Ltd. stellt keine Rechnungen im Namen der Apotheke aus und erhebt oder empfängt keine Gelder. Daher unterliegt sie nicht dem deutschen Steuerrecht. Die steuerlichen Verpflichtungen der Cannurexa Ltd. beschränken sich ausschließlich auf das Vereinigte Königreich, gemäß dem UK VAT Act 1994.

Versand und Lieferung

  • Vorbereitung, Versand und Lieferung der Produkte erfolgen ausschließlich durch die lizenzierte deutsche Apotheke. Die Cannurexa Ltd. besitzt oder betreibt keine Betriebsstätte in Deutschland und handelt nicht als direkter Händler, sondern ausschließlich als „Vermittlungsplattform“ im Sinne des § 5 DDG.

Datenschutz

  • Die Cannurexa Ltd. ist ausschließlich verantwortlich für den Schutz und die Verarbeitung der über die elektronische Plattform übermittelten personenbezogenen Daten gemäß der Datenschutz-Grundverordnung (DSGVO, Art. 5, 6) sowie dem UK Data Protection Act 2018.
  • Medizinische Bestelldaten werden sicher und direkt an die deutsche Apotheke übermittelt, die die volle rechtliche Verantwortung für deren Verarbeitung im Rahmen der gesetzlichen Vorschriften zur medizinischen Behandlung trägt.

Haftungsausschluss

  • Die Cannurexa Ltd. übernimmt keine Haftung für den Inhalt, die Richtigkeit oder die Rechtmäßigkeit der medizinischen Produkte. Diese Verantwortung liegt ausschließlich bei der lizenzierten deutschen Apotheke, die das Produkt sowie die Rechnung bereitstellt.
  • Sämtliche Verbraucherrechte und -pflichten entstehen ausschließlich zwischen dem Kunden und der deutschen Apotheke, gemäß dem deutschen Verbraucherschutzrecht (BGB, HWG, AMG).

Legal Notice

Cannurexa Ltd. is a company registered in the United Kingdom (Companies House, England & Wales, Company No. 16493674) and acts solely as an electronic platform service provider for the display of medical cannabis products and the forwarding of orders to authorized German pharmacies, in accordance with the Companies Act 2006 (Part 41) and The Electronic Commerce (EC Directive) Regulations 2002 (Reg. 6).

 

Contracts and Taxes

  • The purchase contract is concluded exclusively between the patient/customer and the licensed German pharmacy, pursuant to § 312 BGB ff.
  • Invoices and payments are handled directly by the German pharmacy, which bears full tax responsibility in accordance with § 14 UStG (invoicing) and § 1 Abs. 1 Nr. 1 UStG (VAT liability).
  • Cannurexa Ltd. does not issue any invoices on behalf of the pharmacy and does not collect or receive any funds; therefore, it is not subject to German tax law. The tax obligations of Cannurexa Ltd. are limited exclusively to the United Kingdom, in accordance with the UK VAT Act 1994.

Shipping and Delivery

  • Preparation, shipping, and delivery of products are carried out exclusively by the licensed German pharmacy. Cannurexa Ltd. does not own or operate any permanent establishment (Betriebsstätte) in Germany and does not act as a direct trader (“Händler”), but solely as a “Vermittlungsplattform” (intermediary platform) in accordance with § 5 DDG.

Data Protection

  • Cannurexa Ltd. is solely responsible for the protection and processing of personal data submitted through the electronic platform, in compliance with the General Data Protection Regulation (GDPR, Art. 5, 6) and the UK Data Protection Act 2018.
  • Medical order data is securely and directly transmitted to the German pharmacy, which bears full legal responsibility for processing such data within the legal framework of medical treatment.

Liability Disclaimer

  • Cannurexa Ltd. assumes no liability for the content, accuracy, or legality of medical products. This responsibility rests entirely with the licensed German pharmacy, which provides the product and the invoice.
  • All rights and obligations relating to the consumer arise exclusively between the customer and the German pharmacy, in accordance with German consumer protection law (BGB, HWG, AMG).
